Rock Dawg Terms of Use Agreement
 
Please read the following Terms and Conditions carefully. If you do not agree with any of the Terms and Conditions, do NOT use this Website.
 
 
RockDawg.com (the website) is owned and operated in the United States by RockDawg, LLC. To the extent possible, the following general terms and conditions shall apply exclusively to all users of this website (“Users”). By accessing the website, using any services offered on this website (“Services”), or purchasing products (“Products”) you agree to accept and be bound by these Terms of Use (“Agreement”).
 
RockDawg.com has the right, at its sole discretion to change, modify, add or remove the terms and conditions of the Agreement at any time without notice. Your continued use of Services on this website following any posted change or modification signifies that you agree to accept the changes and modifications and you agree to be bound by the Agreement. If you do not agree to the changes, your sole remedy is to cease using the Website. If you breach any of these terms and conditions, or the Privacy policy, your authorization to use this Website automatically terminates.
 
All Users are responsible for checking the website for updates or changes to the Agreement. RockDawg.com logos and trademarks are the property of RockDawg, LLC. All rights reserved. All other trademarks appearing on RockDawg.com are the property of their respective owners.
 
Additional terms and conditions may apply to the use of Services or Products and specific portions or features of the Website, including contest, promotions, or other similar features, all of which terms are made a part of this Agreement by this reference. If there is a conflict between this Agreement and the terms posted for or applicable to a specific portion of the Website or for any service offered on or through the Website, the latter terms shall control with respect to your use of that portion of the Website or the specific Service.
 
By using this Website and/or registering on this Website, or becoming a member of this Website,it will be deemed that you have fully read the Agreement and accepted and agree with the terms and conditions listed as well as our Privacy Policy.  You agree to abide by the terms and conditions including that you are of sufficient legal age to participate or use the Services or use of Products offered on this website. 
 
This agreement shall be binding upon all parties hereto, as well as their agents, servants, successors, assignees, licensees and transferees.
 
RockDawg reserves the right to prohibit or limit the use of our site to anyone for any reason at any time.  RockDawg may ban and/or limit a User from bidding on our site if RockDawg deems that User’s presence to be detrimental to the growth and/or success of our company,
 
Age Limits and Eligibility
Using the Services and/or purchasing Products are void where prohibited. In order to access and use our Website, you must be at least 18 years old and by using this site your represent and warrant that you are at least 18 years of age and a legal resident of the United States. You must certify to us that you have carefully read, understand and agree to all the terms and conditions as well as our Privacy Policy. You many only participate as an individual. You will not be allowed to participate as a firm or any other entity.
 
Registration/Opening an Account
In order to access and participate in the auctions (“Auctions”), including other features of the Website, you must register to create an Account. Your registration request will either be rejected or accepted by RockDawg.com. Your account will be maintained by you in accordance with this Agreement and applicable law.
 
To register for an Account and/or participate in any Auction (including the placing of a bid or purchasing a Product), you must be legally capable of entering into binding contracts and be at least 18 years old.
 
You will be required to open an Account in order to access some or all of the Services. To do so, you will be required to create a username and password, to agree to these terms and conditions and to provide your email address. You may be required to provide additional information and complete additional registration steps.
 
When creating your Account, you agree to only provide accurate and complete information. A postal address must not be used. Registration using P.O. Boxes or equivalents in not permitted.  A valid mailing address must be added to your Account.
 
When creating your Account, the User must provide a username. The username must not be offensive, derogatory, meant to deceive or mis-inform other Users, may not offend common decency or infringe upon the rights of third parties. If RockDawg.com determines a username is illegal or in breach of these Terms, the username can be amended by RockDawg.com or the account suspended without prior notice.
 
Only one Account per person is allowed, and one account per household unless otherwise expressly approved by RockDawg.com. Accounts can only be opened by individuals. Entities, companies, trusts, co-ops, etc. are not authorized to open an account.
 
Use of another Users’ Account is prohibited. User accounts created during registration are not transferable.
 
You are solely responsible for the activity that occurs on your Account, and you must keep your Account password secure. You must notify RockDawg.com immediately of any breach of security or unauthorized use of your Account. RockDawg.com is not liable for any losses caused by unauthorized use of your Account. However, you may be liable for any losses of RockDawg.com or others relating to any such unauthorized use.
 
In order to be fair to all of our Users, RockDawg strictly prohibits the use of any device such as a gaming mouse or any software that would allow a User to gain an unfair advantage over other Users. 
 
At any time, you or RockDawg.com may terminate your Account, for any reason or no reason, with or without notice. If RockDawg.com terminates your Account for any reason other than your violation of this Agreement, the Website rules and regulations, and/or your violation of law, then RockDawg.com will return to you the balance of any purchased and paid bids in your account.
 
RockDawg.com employees and immediate family members living in the same household are not eligible to participate in Auctions. RockDawg.com Products and services are offered exclusively to individuals, private Account holders and not to commercial or partly-commercial resellers.
 
Each User shall be liable for all activities that are undertaken using his or her Account. Any abuse of the user Account, be it to the detriment of third parties or to the detriment of RockDawg.com, shall result in disqualification of the User, suspension of the account and the reporting of a crime. Under no circumstances shall you allow or permit any other person or third party, including without limitation any person under the legal age to participate in an auction in your applicable jurisdiction.
 
RockDawg.com reserves the right to temporarily or permanently disqualify a User, or disable their account at any time at its sole discretion to protect the rights of other Users, or to prevent unauthorized manipulation or use of RockDawg.com. Users will be disqualified if it is determined by RockDawg.com that a User has violated any laws or the rights of third parties. Examples of such unauthorized usage include (but are not limited to) non-payment of bids, use of unauthorized third-party bidding software or multiple User Accounts by the same individual. In case of a breach of these Terms, RockDawg.com reserves the right to withhold deliveries or refunds for bids.
 
WIN LIMITS-
RockDawg.com also reserves the right to limit the number of auctions a User may participate in during a specific period of time or the number of his successfully finished auctions at its sole discretion.  In fairness to all Users, beginning Sunday, December 19th, Rock Dawg has set the win limit to 2 wins per User per day.  Wednesdays will be designated our ONE WIN WEDNESDAY.  Only one win per User on Wednesdays.  Users are responsible for monitoring themselves.  Any bids placed on auctions after the win limit has been reached, and/or auctions won after the win limits have been reached will be lost.  Wins will be forfeited to the next highest bidder who is not over their win limit.  Any monies paid towards auctions won after win limits have been reached will NOT be refunded.  
  
Also, note: that any User who continues to bid against another User who has exceeded their win limit, will NOT be refunded bids even though other Users have unfairly increased the price of the auction.  However, once again, the auction may still be won by default if a User is the next highest bidder who has not exceeded their win limit.  Please DO NOT bid on RockDawg if these rules are unsatisfactory to you!
 
 
Permission to Use the Website
RockDawg.com hereby grants to you permission to use the Website as set forth in these Terms of Use, provided that your use of the Website as permitted is solely for the purposes expressly agreed upon by RockDawg.com; you will not copy or distribute an parts of the Website in any medium; you will not alter or modify any part of the Website; and you will otherwise comply with the terms and conditions of this Agreement.
 
You agree not to use or launch any automated system, including without limitation, “robots,” “spiders,” “offline readers,” etc, that accesses the Website in a manner that sends more request messages to the Website servers in a given period of time quicker than a human could reasonably produce in the same period by using a convention on-line web browser. You agree to use the Website and/or the Services only in a manner consistent with any and all applicable laws and regulations, and this Agreement. You agree that you will not post any telephone numbers, street addresses, last names, URLs or email addresses, unless otherwise expressly permitted by RockDawg.com. You agree not to advertise, or solicit any User to buy or sell any Products or Services and not to transmit any chain letters or junk email to other Users. You agree that you will not, nor will you permit others to cover or obscure any banner or other advertisements on any RockDawg.com page. You agree not to disclose your password to any third, party or permit any third party to access your Account.
 
Purchasing Bids (Bid Bones) to Play
In order to place a bid on RockDawg.com, you are required to purchase bid packages (“Bid Bones”) in specified quantities and dollar amounts identified at RockDawg.com. Bids and (“Bid Bones”) can also be obtained from other methods such as winning or receiving as a part of a promotion or giveaway or through an affiliate program from RockDawg.com. Minimum and maximum limits are determined solely by RockDawg.com and may change at our sole discretion. All funds will be paid, tracked and maintained in United States Dollars, unless otherwise stated and shall not bear interest. 
 
RockDawg.com uses PayPal to process all payments. The information that we provide to and receive from PayPal and the manner, in which such information is used and disclosed, is described in our Privacy Policy. You irrevocably authorize us, as necessary, to instruct PayPal to process your credit card transactions and irrevocably agree that provider may give such instruction on your behalf, in accordance with your requests, as submitted through the Website. You further agree that provider is not liable for any loss caused by any unauthorized use of your credit card or other method of payment by a third party, except as a result of gross negligence of provider or its employees.
 
Payment for BidBundles (“Bid Bones”) shall be made by credit/debit card, PayPal or such other authorized payment method identified on RockDawg.com. Bids or BidBundles (“Bid Bones”) are not transferable. 
 
If any payment by a User for BidBundles (“Bid Bones”) is returned or dishonored, the User will be charged a fee of $25.00. RockDawg.com reserves the right to disable the User’s Account until all obligations are paid in full. Other rights or remedies may apply. Refunds for expired bids will not be issued under any circumstances. Paid bids will expire following inactivity of a User Account for one year.
 
Any purchased BidBundles (“Bid Bones”), or bids in your active account are valid for the duration of your active Account. Refunds will not be issued for Bids placed in an Auction, expired Bids, Voucher Bids or Free Bids. When a Bid is placed in an Auction, the bid is deducted from the User’s Account and can no longer be used. Users are prohibited from using unauthorized bidding software, including but not limited to “robots”,
 
Bidding
In order to access and participate in the auctions (“Auctions”), including other features of the Website, you must register to create an Account. Your registration request will either be rejected or accepted by RockDawg.com. Your account will be maintained by you in accordance with the Agreement and applicable law.
 
In order to participate in the auction, the User must place a bid on an item. Each time the User clicks on the bid bone, the price of the item, on which the User is bidding increases by 0.01 with each bid or by the amount specified on the item and one bid bone, or credit is deducted from the User’s account. Each bid submitted by the User constitutes a willingness to enter into a binding contract with RockDawg.com. And each bid submitted by the User constitutes an irrevocable offer to purchase the product under the terms and conditions and in accordance with this auction.
 
COLLUDING -
Bidders can only maintain one account per household. Multiple accounts and multiple bidding from dual accounts on the same auction are prohibited. In the event of collusion, the Auction will become void and all bids will be refunded. Users found to be in violation of this policy will be disqualified and will result in the suspension of the Account.
 
Users can bid in two ways online. Bids can be placed by manually clicking on the relevant bid buttons, or can be placed automatically by an Autobidder. The AutoBidder is only authorized on select Auctions that retail over $50 and will be noted on such Auctions.
 
The AutoBidder assists bidders in being able to bid on an auction even if they are not online at that time. The AutoBidder automatically submits bids according to the specifications set in advance by the user. The User is prohibited from using unauthorized bidding software, and doing so will result in immediate termination of the Account, disqualification and the User will be banned from use of Services from the Website without refund.
 
RockDawg.com is not responsible for the inability to place a bid for any reason including the inability to access the website, and/or any other technical difficulties or any kind. In the event a bid is not able to process and/or the Auction is interrupted due to technical difficulties from our hardware or software, the Auction will become void and all bids will be refunded for that particular auction. If you are dissatisfied with any portion of this Website and/or Services offered through the Website, your sole and exclusive remedy is to discontinue your use of this Website.
 
Given the nature of the internet, RockDawg.com cannot, and will not guarantee that any last second bid will be able to be processed by our servers. Therefore, RockDawg.com recommends that Users place bids within three (3) seconds remaining on the clock to ensure that your bid is properly credited.
 
Winning – Purchasing the Item
Each new bid resets the ‘remaining time’ for an auction up to, but not above, the countdown reset value (usually 10, 15, 20 or 30 seconds) unless otherwise stated. The auction ends when the remaining time reaches zero. The User who was the last to bid /(throw the Dawg a bone) then wins the Auction. All other bids placed on the item expire and will not be credited back to the User’s account or be eligible for a refund. 
 
Upon completion of the Auction, RockDawg.com will determine the winning bidder based upon our records and will be made at our sole discretion. An agreement for purchase of the Product (“Invoice”) shall be made and be binding upon the User and RockDawg.com under the terms and conditions of this Agreement.
  
The successful bidder of each Auction agrees to pay the purchase price, plus any applicable shipping costs and taxes within five (5) days of the win. If an Auction has not been paid within five (5) days, RockDawg.com reserves the right to reject and withdraw the offer to purchase the Product and the winner’s right to pay for and receive delivery of an item will be permanently revoked. Bids used to win the item will not be refunded.
 
Upon payment of the applicable purchase price, shipping costs and taxes, RockDawg.com shall initiate the shipment of the Product to the address information supplied by the wining Bidder. Users are required to maintain accurate information in the Member profile. If inaccurate information or invalid billing information is submitted, the User Bid(s) may be canceled.
  
Delivery - Shipment
Unless otherwise stated, delivery will be made directly from our suppliers or from our warehouse. Deliveries are made within the 50 states of the United States (excluding the U.S. sovereign territories of Guam, Puerto Rico and the U.S. Virgin Islands). Canadian Bidders - see below.  Some restrictions or higher shipping costs may apply if the delivery address is in Alaska or Hawaii or outside the continental US. Shipping details are noted on each Auction. In order to expedite delivery of your Product, RockDawg.com reserves the right to ship via the carrier of our choice. However, in most instances your Products will be shipped via Fed-Ex, UPS or USPS.
 
*Note: RockDawg will only ship physical cards unless you have purchased bids from us - then and only then, will we be able to ship an eCard.
 
Canadian Bidders-
Our Canadian friends may now participate in RockDawg's auctions in a limited way.  Canadian bidders may bid on Bid Bone packs and Gift Cards only.  Any and all gift cards won will be substitued with Amazon.com Email Gift Cards.  No physical items will be shipped to Canada.  Because RockDawg has strong buying power, we are sometimes able to offer items that we have obtained at a substantially lower price than normal retail.  If a Canadian bidder bids on a physical item, it may be substitued with an Amazon.com Email card that has a far reduced value than that of the suggested retail of the physical item.  In order to obtain like value, we strongly urge our Canadian buyers to bid on Bid Bones and Gift cards only. 
 
Delivery Times-
Delivery times vary and any delivery time indicated is provided only as a guide and is not guaranteed. Should RockDawg.com be unable to deliver the item purchased, RockDawg.com shall be entitled to substitute the item with a comparable replacement product or provide a refund of the purchase price including any shipping charges and taxes paid.
 
Obvious damage to the item from transport is to be reported to RockDawg.com upon delivery. RockDawg.com reserves the right to involve third parties to satisfy its contractual obligations without being required to notify the buyer.
 
Refund Policy
Items can be returned for a full refund within seven (7) days of the shipment date, if the item was received in a faulty state. In order to be eligible for a refund, the item will need to be accompanied by the original invoice included with shipment. Open, used or items damaged by the recipient cannot be returned. All returned items must be in their original packaging and must be accompanied by all media, manuals, accessories and contents of the original packaging. Sets/boxes can only be returned in their entirety. Return shipping charges and postage will be paid by the User. 
 
Should RockDawg.com incur additional costs from insufficient postage on the return or for courier shipments and other irregular shipping methods that are over and above postal shipping costs, these costs will be deducted from any payment whatsoever remitted by the customer.
   
Product Warranties and Support
All requests for technical service, support and warranties should be made directly to the manufacturer in accordance with their terms and conditions. All items purchased through the Website are sold only with the manufacturer’s limited warranty.
 
Other Terms and Conditions
User Disputes – You are solely responsible for your interactions with other Users. RockDawg.com reserves the right, but has no obligation, to monitor disputes between you and other Users.
 
Non Commercial Use by Users –
The Services are for your personal use and may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by RockDawg.com. Illegal and/or unauthorized use of the Services, including collecting usernames and/or email address of Users by electronic or other means or unauthorized framing of or linking to the Services are prohibited. Commercial advertisements, affiliate links, and other forms of solicitation may be removed without notice and may result in termination of Account privileges, which is without limitation to any other legal action that may be taken by RockDawg.com.
 
Disclaimers –
RockDawg.com is not responsible for any incorrect or inaccurate content posted on the Website or in connection with any of the Services provided, whether online or offline, or by any User. RockDawg.com assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft of destruction or unauthorized access to, or alteration of, any of the Services or Products. RockDawg.com is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or players due to technical problems or traffic congestion on the Internet or at an of the Services or combination thereof, including any injury or damage to Users and/or Users or to any person’s computer related to or resulting from participation or downloading materials in connection with the Website and/or in connection with the Services or Products. Under no circumstances shall RockDawg.com be responsible for any loss or damage, including personal injury or death, resulting form the use of the Website or the Services or from any content posted on the Website or transmitted to Users, or any interactions between Users, whether online or offline. The website and the services are provided “AS IS, “WITHOUT ANY WARRANTIES, EXPRESS ON IMPLIED, AND ROCKDAWG.COM EXPRESSLY DISCLAIMS ANY IMPLIED WARRANTY OF FITNESS OF A PARTICULAR PURPOSE  OR MERCHANTABILITY.  ROCKDAWG.COM DOES NOT GUARANTEE AND DOES NOT PROMISE ANY SPECIFIC RESULTS FROM USE OF THE WEBSITE, PRODUCTS AND/OR SERVICES.
 
LIMITATION ON LIABILITY –
IN NO EVENT SHALL ROCKDAWG.COM OR ITS SUPPLIERS OR LICENSORS BE LIABLE TO YOU OR TO ANY THIRD PARTY UNDER ANY CONTRACT, TORT, STRICT LIABILITY, NEGLIGENCE OR UNDER LEGAL OR EQUITABLE THEORY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT DAMAMGES ARISING FROM YOUR USE OF THE WEBSITE AND OF THE SERVICES, EVEN IF ROCKDAWG.COM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, ROCKDAWG.COM’S LIABILITY FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO AMOUNT ACTUALLY PAID, IF ANY, BY YOU TO ROCKDAWG.COM FOR THE SERVICES DURING THE TERM OF YOUR ACCOUNT.
 
Governing Law –
This Agreement will be governed by and construed in accordance with the laws of the state of California without regard to conflict of laws provision, the actual state or country of execution or loss or any different state laws that may govern these Terms of Use. THE CALIFORNIA COURTS (STATE AND FEDERAL), SHALL HAVE SOLE JURISDICITOIN OF ANY AND ALL CONTROVERSIES ARISING OUT OF OR RELATED TO THIS AGREEMENT; ANY ACTION OR OTHER PROCEEDING WHICH INVOLVES SUCH A CONTROVERSY SHALL BE BROUGHTR SOLELY IN COURTS IN CALIFORNIA AND NOT ELSEWHERE. THE PARTIES WAIVE ANY AND ALL OBJECTONS TO VENUE IN THOSE COURTS AND HEREBY SUBMIT TO THE JURISDICTION OF THOSE COURTS. Any claim under these Terms of Use must be brought within one (1) year after the cause of action arises, or such claim or cause of action is barred. No recovery may be sought or received for damages other than out-of-pocket expenses, except that the prevailing party will be entitled to costs and attorneys’ fees. In the event of any controversy or dispute between RockDawg.com and you arising out of or in connection with your use of the Website, the parties shall attempt, promptly and in good faith to resolve any such dispute.
 
Indemnity –
You agree to indemnify and hold RockDawg.com its subsidiaries, members, managers, affiliates, officers, agents, lawyers, accountants, licensors, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of the Website or any of the Services in violation of these Terms of Use; arising from your breach of these Terms of use; arising from your violation of applicable law or court order; and/or arising from your negligence.
 
Void Where Prohibited –
RockDawg.com administers and operates the Website from its location; Although the Website is accessible worldwide, not all features, Products or Services discussed, referenced, provided or offered through or on the Website are available to all persons or in all geographic locations, or appropriate or available for use outside the United States. RockDawg.com reserves the right to limit, in its sole discretion, the provision and quantity of any feature, product or service to any person or geographic area. Any offer for any feature, product or service made on RockDawg.com is void where prohibited. If you choose to access the Website from outside the United States, you do so at your own initiative and you are solely responsible for complying with applicable local laws.
 
Other –
Except for any additional written agreements(s) between you and RockDawg.com, these Terms of Use constitute the entire agreement between you and RockDawg.com regarding the use of the Website and/or any of the Services. The failure of RockDawg.com to exercise or enforce any right or provision of these Terms of Use shall not operate as a waiver of such right or provision. All rights not expressly granted to you in these Terms of Use are reserved to RockDawg.com and/or its licensors. This Agreement is not assignable or transferable or sub-licensable by you except with RockDawg.com’s prior written consent. RockDawg.com may transfer, assign or delegate these Terms of Use and its rights and obligations without consent. The section titles in these Terms of Use are for convenience only and have no legal or contractual effect. Please contact us with any questions regarding these terms of Use.
 
DISCLAIMER OF WARRANTY AND LIMITATION OF LIABILITY REGARDING THE USE OF ROCKDAWG.COM –
USER EXPRESSLY AGREES THAT USE OF ROCKDAWG.COM’S SERVICES IS AT USER’S SOLE RISK. NEITHER ROCKDAWG.COM, ITS AFFILIATES NOR ANY OF THEIR RESPECTIVE EMPLOYEES, AGENTS, THIRD PARTY CONTENT PROVIDERS OR LICENSORS WARRANT THAT ROCKDAWG.COM WILL BE UNINTERRUPTED OR ERROR FREE. NOR DO THEY MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM USE OF ROCKDAWG.COM, OR AS TO THE ACCURACY, RELIABILITY OR CONTENT OF ANY INFORMATION, SERVICE OR MERCHANDISE PROVIDED THOUGH ROCKDAWG.COM.
